We currently have a requirement for 2 short-term specialists (STSs). The Technical Building Specialist (TBS) will be required to work on the drafting of the Timor-Leste Building Code and its associated documents. Six months input is required. The Technical Legal Specialist (TLS) will be required to work closly with the TBS in drafting a new Directive on the Building Regulation of Timor-Leste and the preparation of a new decree law to cover the Development Control and Building Decree for Timor-Leste. Three months input is required. There is a need to finalise a Directive within the MoI for the purpose of establishing the Building Code of Timor-Leste and the control, regulation and administration of all development, building works and related land planning. In addition, there is the need to formally establish a Building Permit system and guidelines for the issue of Certificates of Occupancy and Use. The ADB IPM is providing funds for two short term specialists to prepare the legislation for the Timor-Leste Building Code, building regulations, building permits & occupancy permits. The specialist team will: draft the revised Building Regulations of Timor-Leste; draft the Decree Law document for 'Development Control and Building Decree of Timor-Leste'; prepare the legislation for the Building Permit; and,Certificate of Occupancy and Use; prepare legal documentation leading to the registration of all professionals; prepare the legal framework for the Building Advisory Council; and, Building Appeals Board; advise on the legal standing of the new Low Rise Building Code. - Applicant Requirements:
Technical Building Specialist The Technical Building Specialist (TBS) will be required to work on the drafting of the Timor-Leste Building Code and its associated documents. The Technical Building Specialist will carry out the following tasks: review the existing 2003 'Building Regulations of East Timor' and draft improvements necessary to bring them in line with current best practice being used in developing countries; review the draft Building Permit requirements and recommend improvements to the system; review the draft Certificate of Occupancy and Use documentation and recommend improvements to the implemetaion of the Certificate; prepare documentation leading to the required registration of all professionals involved in the design, supervison and certification phases of the development of the Building Permit process; prepare documentation leading to the required registration of all contractors involved in trade based construction activities; recommend and obtain approval for the TOR for the Building Controller; prepare the TOR for the Building Advisory Council and recommend the makeup of the Council delegates; prepare the TOR for the Building Appeals Board and recommend the makeup of the Board; review the prescribed fee structure, offences, fines and penalties linked to the Building Permit; update and improve on the present 2002 Low Rise Building Code; oversee the translation into Bahasa of the final Building Code, Building Regulations and other documents produced; work closely with the appointed Technical Legal Specialist on all matters; provide on-the-job training in both English and preferably also Bahasa to the MoI building controllers and supervisors in the implementation of the Building Code, the Regulations, the Building Permit and granting of Occupancy Certifictes; and, carry out any further building code related work as required. The TBS should have a minimum of 10 years project management experience in the urban planning, building and housing fields and have worked extensively with building codes and regulations in a similar environment. The TBS must be fluent in spoken and written English and Portugese, since the specialist will be required to prepare high-quality Portugese and English language documentation and be able to read and understand the many Portugese language documents in use within the MoI. A knowledge of Bahasa Indonesian would be an advantage as many of the documents prepared will have to be translated into Bahasa. Technical Legal Specialist The Technical Legal Specialist (TLS) will be required to work closly with the TBS in drafting a new Directive on the Building Regulation of Timor-Leste and the preparation of a new decree law to cover the Development Control and Building Decree for Timor-Leste. The Technical Legal Specialist will carry out the following tasks: draft the revised Building Regulations of Timor-Leste incorporating the recommended improvements prepared by the TBS and prepare a Directive on 'The Building Regulations of Timor-Leste'; draft the decree law document for 'Development Control and Building Decree of Timor-Leste'; prepare the legislation for the Building Permit; prepare the legislation for the Certificate of Occupancy and Use; prepare legal documentation leading to the registration of all professionals involved in the design, supervison and certification phases of the development of the Building Permit process; prepare legal documentation leading to the registration of all contractors involved in the trade based construction activities; prepare the legal framework for the Building Advisory Council; prepare the legal framework for the Building Appeals Board; advise on the legal implications of the prescribed fee structure, offences, fines and penalties linked to the Building Permit; advise on the legal standing of the new Low Rise Building Code; oversee the translation work into Bahasa of the Building Code, Building Regulation and other produced documents; and, provide on-the-job training in both English and Bahasa to the MoI building controllers and supervisors in the legal implications of the Building Code, the Regulations, The Building Permit and granting of Occupancy Certificates. The TLS will have a minimum of 10 years legal experience linked to the preparation of legislation connected with urban planning, building and housing fields and have worked extensively with the formulation of this legislation in a similar environment. The TLS must be fluent in spoken and written English and Portugese, since the specialist will be required to prepare high-quality Portugese and English legal language documentation and be able to read and understand the many Portugese language documents in use within the MoI.
